Open Culture is a social community project with the aim of encouraging people, whether individuals, groups or organisations, to engage in the creation and exhibition of cultural content.


The Open Culture website is public multi-platform exhibition space as well a forum for the discussion and stimulation of culture in all its forms and definitions.


Open Culture is a project currently formed as an alliance between The Liverpool Daily Post & Echo, Radio City GroupBBC Radio Merseyside and the ICDC at Liverpool John Moores University and is supported by Northwest Development Agency, Culture Liverpool and FACTThe organisation, administration, management and any necessary legal constitution of Open Culture and any project that flows from it will be left to the sole discretion of the alliance members.


 

TERMS & CONDITIONS

As such anyone using the Open Culture website agrees:

1.      Whatever work or contribution is submitted becomes immediately available in the public domain for anyone to download, print or copy for individual private use.


2.      Members of the Open Culture alliance will be granted a non-exclusive licence imperpetuity to use whatever work or contribution that is submitted for any purposes related to non-profit making promotion, publicity, education or cultural display and distribution whether as individual works or parts of greater collections.
 

3.      This non-exclusive not for profit licence will extend to any legally connected company or entity of any alliance member.
 

4.      Contributors recognise that Open Culture will not be able to consult over every individual work in terms of exhibition, display, layout or publicity and promotional material but that the general ethos is to promote an environment in good faith in which cultural content can be encouraged and stimulated for the general public good.
 

5.      As such Open Culture will try but cannot guarantee to make sure that credit will be given to any contribution through either initial exhibition or inclusion on any related website or online presence.
 

6.      Following the above conditions and by submitting work for inclusion in any Open Culture initiative contributors are agreeing to all of the terms and ethos of the overall Open Culture initiative.

7.      Any commercial exploitation of any individual work by any member of the Open Culture alliance will, if possible and practicable, return the following fees and percentages of any normal market income for contributors, whether as a one off or royalty payment:                                  

- in
 the case of individual contributors
- £10 advance and 50% to the individual originator; 1% to support the future work of the Open Culture initiative and 49% to itself. 
                                
in the case of up to four contributors to a single project
- £10 advance and 60%, to the originators; 1% to support the future work of the Open Culture initiative and 39% to itself. 
in the case of multiple contributors to a single project
- £10 advance and 50% to support the future work of the Open Culture initiative and 39% to itself. Any such fees or income due will as a rule be sent annually to keep administration costs down to the address, if any, registered at the time of exploitation although Open Culture reserves the right to change this time period.
 

8.      Any contributor will be free to market and exploit their own work but agrees to contribute a one off fee as determined by Open Culture from time to time, but currently £10, together with an undertaking to return 1% of any income generated as donations to support the future work of Open Culture on an annual basis. Open Culture reserves the right to amend these fees and percentages.
 

9.      Contributors also agree to allow their names and likenesses to be used in any publicity, promotional, educational or cultural display.
 

10.  Contributors recognise that Open Culture will not be able to consult over every individual work in terms of exhibition, display, layout or publicity and promotional material but that the general ethos is to promote an environment in good faith in which cultural content can be encouraged and stimulated for the general public good.
